Terms of Service
Effective Date: August 31, 2026
Last Updated: August 31, 2026
These Terms of Service (“Terms”) govern your use of the website, communications, programs, services, and other offerings provided by the Institute of Massage & Performance (“IMP,” “we,” “us,” or “our”).
By accessing or using our website, submitting information to us, requesting information, registering for an event, scheduling an appointment, applying to a program, or otherwise interacting with IMP, you agree to these Terms where applicable.
1. About the Institute of Massage & Performance
The Institute of Massage & Performance provides massage therapy education, professional and continuing education, performance-related education and services, student clinic services, events, and related programs and resources.
Certain programs, courses, applications, enrollments, appointments, services, or transactions may be governed by additional agreements, policies, school catalogs, enrollment documents, disclosures, or terms. If there is a conflict between these Terms and a specific written agreement applicable to a particular program or transaction, the specific written agreement will control with respect to that program or transaction.
2. Website Use
You may use our website for lawful purposes and to learn about IMP, request information, communicate with us, apply for programs, schedule available services, access resources, or complete other functions we make available.
You agree not to:
Use the website for fraudulent, unlawful, abusive, or harmful purposes.
Attempt to gain unauthorized access to our website, systems, accounts, or data.
Interfere with the operation or security of the website.
Introduce malicious software, automated attacks, or other harmful technology.
Misrepresent your identity or submit materially false information.
Copy, reproduce, distribute, or commercially exploit website content except as permitted by law or with our written authorization.
We may modify, suspend, restrict, or discontinue portions of the website or its functionality at any time.
3. Program Information, Applications, and Enrollment
Information presented on our website concerning educational programs, schedules, tuition, admissions, instructors, curriculum, events, services, or other offerings is provided for informational purposes and may be updated from time to time.
Submission of an inquiry, application, or other form does not by itself guarantee admission, enrollment, eligibility, availability, certification, licensure, employment, or completion of any program.
Applicants and students may be required to satisfy additional admissions requirements, execute enrollment agreements, provide supporting documentation, pay applicable fees, and comply with school policies and applicable regulatory requirements.
Program-specific enrollment agreements, catalogs, policies, and disclosures remain controlling where applicable.
4. Fees, Payments, and Refunds
Certain IMP programs, services, applications, registrations, appointments, events, or products may require payment.
Prices, deposits, tuition, application fees, registration fees, cancellation policies, and refund terms may vary depending on the particular program or service.
Any program-specific payment, cancellation, or refund terms presented during registration, enrollment, scheduling, checkout, or in an applicable written agreement will govern that transaction.
Payments may be processed by third-party payment processors. IMP generally does not directly store complete payment-card information submitted through such payment processors.
5. Appointments and Student Clinic Services
Where IMP offers appointments, massage services, student clinic services, consultations, tours, interviews, or other scheduled activities, availability is not guaranteed until confirmed.
Applicable scheduling, rescheduling, cancellation, late-arrival, payment, health-screening, and service policies may be provided at the time of booking or through separate documentation.
Student clinic services may be performed by students as part of their education and training under applicable supervision.
Nothing on this website should be interpreted as medical advice, diagnosis, or a substitute for evaluation or treatment by an appropriately licensed healthcare professional.
6. Email and Other Communications
If you provide us with your email address or other contact information, IMP may communicate with you regarding inquiries you initiate, applications, admissions, enrollment, appointments, schedules, transactions, events, services, or other matters related to your relationship with IMP.
Where required by law, promotional communications will be sent only after obtaining any required consent.
You may unsubscribe from promotional emails by following the unsubscribe instructions included in those emails. Certain administrative, transactional, enrollment-related, or other non-promotional communications may still be sent when appropriate.
7. SMS/Text Messaging Terms
IMP offers text messaging programs for individuals who expressly choose to receive SMS communications from the Institute of Massage & Performance.
Consent to receive SMS messages is voluntary. Providing a telephone number does not by itself constitute consent to receive marketing text messages, and consent to receive marketing text messages is not a condition of purchasing, applying, enrolling, receiving services, or otherwise doing business with IMP.
Marketing Text Messages
If you separately opt in to receive marketing text messages from the Institute of Massage & Performance, messages may include information about programs, upcoming classes, enrollment opportunities, events, special offers, promotions, discounts, educational resources, and other marketing communications.
Non-Marketing Text Messages
If you separately opt in to receive non-marketing text messages from the Institute of Massage & Performance, messages may include responses to inquiries, admissions or application communications, scheduling information, appointment confirmations and reminders, enrollment updates, program or class information, administrative notices, event information, customer-care communications, and other messages relating to services or interactions you have requested.
Consent to marketing text messages and consent to non-marketing text messages may be collected separately. You may choose to consent to one category, both categories, or neither category where those options are presented.
Age Requirement
You must be at least 18 years of age to opt in to and participate in the Institute of Massage & Performance SMS messaging program. By providing consent to receive SMS messages from Institute of Massage & Performance, you confirm that you are at least 18 years old.
Message Frequency
Message frequency may vary depending on your interactions with IMP, the services or programs you request, and the types of text messages to which you have consented.
Message and Data Rates
Message and data rates may apply to messages sent to you by IMP and messages you send to IMP. Your wireless carrier's standard messaging and data rates may apply. Contact your wireless provider if you have questions regarding your text or data plan.
Opting Out
You may cancel SMS messaging at any time by replying STOP to an IMP text message.
After you send STOP, you may receive a text message confirming that you have been unsubscribed. After your opt-out request has been processed, you will no longer receive text messages covered by that opt-out unless you subsequently provide consent again.
If you later wish to receive text messages again, you may opt in again through an available IMP opt-in method.
Help and Support
For assistance with IMP text messaging, reply HELP to an IMP text message.

8. Telephone and Automated Communications
IMP may communicate by telephone regarding inquiries, applications, appointments, programs, enrollment, services, or other interactions.
Where consent is required by applicable law before placing a marketing call or a call using an artificial, prerecorded, or AI-generated voice, IMP will obtain the applicable consent before placing such a call.
Consent to receive marketing or automated telephone calls is not created merely by agreeing to receive text messages unless the applicable consent language expressly states otherwise.
You may request that IMP stop placing promotional calls to your telephone number by informing the caller or contacting us using the contact information contained in these Terms.
9. Privacy
Your use of the website and your interactions with IMP are also subject to our Privacy Policy, which describes how we collect, use, disclose, and protect personal information.
The Privacy Policy is incorporated into these Terms by reference.
10. Third-Party Services and Links
Our website may use or link to third-party platforms and services, including payment processors, scheduling systems, communications platforms, social networks, analytics providers, educational resources, and other external websites or services.
Third-party services may be governed by their own privacy policies and terms. IMP is not responsible for the content, availability, security, privacy practices, or independent actions of third-party websites or services that we do not control.
11. Intellectual Property
Unless otherwise stated, the content on the IMP website, including text, graphics, branding, logos, photographs, videos, educational materials, design elements, and other content created or owned by IMP, is protected by applicable intellectual-property laws.
You may view and use website content for your own lawful, personal, and informational purposes. No ownership rights are transferred to you by your use of the website.
You may not reproduce, distribute, modify, publish, sell, license, or commercially exploit protected IMP content without permission except where permitted by applicable law.
12. Disclaimer of Warranties
To the extent permitted by law, the website and general website content are provided on an “as is” and “as available” basis.
IMP makes reasonable efforts to provide accurate and useful information but does not warrant that all website content will always be complete, current, error-free, uninterrupted, or suitable for every purpose.
Nothing on the website constitutes a guarantee of educational, employment, licensing, career, financial, medical, health, or other outcomes.
Nothing in this section limits warranties or rights that cannot legally be waived.
13. Limitation of Liability
To the extent permitted by applicable law, IMP will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use the website.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.
Program-specific, service-specific, or transaction-specific agreements may contain additional terms concerning liability and responsibilities.
14. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, website, communications practices, legal obligations, or business operations.
When we make changes, we will update the “Last Updated” date shown at the top of this page.
Material changes will apply prospectively as required by applicable law. Your continued use of our website after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by law.
15. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where another law is required to apply.
Nothing in these Terms alters rights or protections that cannot be waived under applicable federal, state, or local law.
